This Legal Notice and Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Lustra Auto Spa/Surface Theory ("Company," "we," "us," or "our"), located in the Fox Valley, Wisconsin area. By accessing our website, booking services, or engaging with our business, you agree to be bound by these Terms. 

1. Acceptance of Terms 

By using our website, scheduling appointments, or receiving auto detailing services from Lustra Auto Spa/Surface Theory, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services or website. 

2. Services Description 

Lustra Auto Spa/Surface Theory provides professional automotive detailing services including, but not limited to: 

Exterior washing and decontamination 

Paint correction and polishing 

Ceramic coating application 

Interior cleaning and sanitization 

Leather and upholstery treatment 

Engine bay detailing 

Headlight restoration 

Mobile detailing services 

Shop-based detailing services 

All services are performed by trained professionals using industry-standard equipment and products. Service descriptions on our website are subject to availability and may be modified without prior notice. 

3. Service Limitations & Disclaimers 

3.1 No Guarantee of Perfection 

While we strive for excellence in all services, the Company does not guarantee the complete removal of all stains, scratches, swirl marks, oxidation, odors, or other defects. Some conditions may be permanent or beyond the scope of detailing services. Pre-existing damage, aging materials, or severe contamination may limit achievable results. 

3.2 Pre-Existing Conditions 

Client acknowledges that detailing processes may reveal pre-existing damage, defects, or imperfections that were previously hidden by dirt, grime, wax buildup, or other contaminants. The Company is not responsible for: 

Paint defects, chips, scratches, or clear coat failure existing prior to service 

Cracked, torn, or deteriorated upholstery, leather, vinyl, or plastic trim 

Faded, peeling, or damaged window tint 

Mechanical or electrical malfunctions 

Pre-existing water damage, mold, or odors 

Rust, corrosion, or structural damage 

Loose or missing trim pieces, emblems, or moldings 

3.3 Material Risks 

Client understands that professional detailing involves the use of: 

High-pressure water and steam equipment 

Chemical cleaning agents and solvents 

Polishing machines and abrasive compounds 

Heat-generating tools 

These tools and materials, while used with professional care, carry inherent risks when applied to aging, damaged, or improperly maintained vehicles. 

4. Liability Limitations 

4.1 General Liability Waiver 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO OUR SERVICES, INCLUDING BUT NOT LIMITED TO: 

Loss or damage to vehicle components 

Mechanical or electrical failures 

Loss of personal property left in vehicle 

Business interruption or loss of use of vehicle 

Any damages exceeding the amount paid for services rendered 

4.2 Vehicle Condition Acknowledgment 

Client certifies that: 

The vehicle is in safe operating condition 

All mechanical and electrical systems are functioning properly prior to service 

Client is the legal owner or has full authorization to have services performed 

Client has disclosed any known damage, defects, or special conditions 

Client has removed all valuables and personal items from the vehicle 

4.3 Personal Property 

The Company is not responsible for any personal belongings, valuables, or items left in the vehicle. This includes but is not limited to cash, jewelry, electronics, tools, accessories, aftermarket modifications, loose items, or any property not permanently affixed to the vehicle. Client assumes full risk for any items left in the vehicle during service. 

4.4 Maximum Liability Cap 

In the event the Company is found liable for any damages, our total liability shall not exceed the total amount paid by Client for the specific service that gave rise to the claim, or $500, whichever is less. 

5. Client Responsibilities 

Client agrees to: 

Provide accurate vehicle information and disclose known issues 

Remove or secure all personal property before service 

Ensure vehicle is accessible and safe for service (mobile services) 

Keep pets and children away from work areas during service 

Provide reasonable access to water and electricity (mobile services) 

Notify Company of cancellations at least 24 hours in advance 

Inspect vehicle upon completion and report concerns immediately 

6. Payment Terms 

6.1 Pricing 

All prices are quoted in U.S. Dollars and are subject to change without notice. Final pricing may vary based on vehicle size, condition, and additional services requested. Quotes provided are estimates and may be adjusted based on actual vehicle conditions. 

6.2 Payment Methods 

We accept cash, credit cards, debit cards, and digital payment methods. Payment is due upon completion of services unless otherwise arranged in writing. 

6.3 Cancellation Policy 

Cancellations must be made at least 24 hours prior to scheduled appointment. Late cancellations or no-shows may be subject to a cancellation fee of up to 50% of the scheduled service cost. 

7. Scheduling & Appointments 

Appointment times are estimates and may be affected by weather, vehicle condition, or unforeseen circumstances. The Company reserves the right to reschedule appointments when necessary. For mobile services, inclement weather, extreme temperatures, or unsuitable work conditions may require rescheduling at Company's discretion. 

8. Warranty & Satisfaction 

8.1 Service Warranty 

We stand behind our work. If you are not satisfied with our services, please contact us within 48 hours of service completion. We will make reasonable efforts to address legitimate concerns, which may include re-cleaning specific areas. This warranty does not cover: 

Normal wear and tear after service completion 

Damage caused by client or third parties after service 

Environmental contamination (bird droppings, tree sap, etc.) 

Conditions disclosed as unrepairable during initial assessment 

8.2 Ceramic Coating Warranty 

Ceramic coating services may include manufacturer warranties separate from our service warranty. Warranty terms, coverage, and maintenance requirements will be provided in writing. Warranty validity requires adherence to specified maintenance procedures. 

9. Indemnification 

Client agrees to indemnify, defend, and hold harmless the Company, its owners, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to: 

Client's breach of these Terms 

Client's misrepresentation of vehicle ownership or authorization 

Claims by third parties related to the vehicle or property 

Client's negligence or willful misconduct 

Any violation of applicable laws or regulations by Client 

10. Website Use & Intellectual Property 

10.1 Copyright 

All content on this website, including text, graphics, logos, images, videos, and software, is the property of Lustra Auto Spa/Surface Theory and is protected by U.S. and international copyright laws. Unauthorized use, reproduction, or distribution is prohibited. 

10.2 Trademarks 

"Lustra Auto Spa" and "Surface Theory" are trademarks of our company. All other trademarks, service marks, and trade names referenced on this website are the property of their respective owners. 

10.3 Website Disclaimer 

Information on this website is provided "as is" without warranties of any kind, either express or implied. We make reasonable efforts to ensure accuracy but do not warrant that website content is complete, reliable, current, or error-free. We reserve the right to modify, suspend, or discontinue any aspect of the website at any time. 

11. Privacy & Data Collection 

We collect and use personal information in accordance with our Privacy Policy. By using our services, you consent to our collection and use of personal data as described in our Privacy Policy, which is incorporated by reference into these Terms. 

12. Photography & Marketing 

By using our services, Client grants the Company permission to photograph the vehicle before, during, and after service for quality control, portfolio, marketing, and promotional purposes. If you do not wish your vehicle to be photographed or used in marketing materials, please notify us in writing before service begins. 

13. Dispute Resolution 

13.1 Governing Law 

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. 

13.2 Informal Resolution 

In the event of any dispute, claim, or controversy arising from these Terms or our services, the parties agree to first attempt to resolve the matter through good-faith negotiation. 

13.3 Arbitration 

If informal resolution is unsuccessful, any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Wisconsin. Each party shall bear its own costs and fees. 

13.4 Small Claims Court 

Notwithstanding the arbitration provision, either party may pursue claims in small claims court if the claim qualifies for such court's jurisdiction. 

13.5 Class Action Waiver 

Client agrees that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. 

14. Force Majeure 

The Company shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, weather conditions, natural disasters, power outages, labor disputes, government actions, pandemics, or other force majeure events. 

15. Severability 

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. 

16. Entire Agreement 

These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between Client and Company regarding our services and supersede all prior or contemporaneous understandings and agreements. 

17. Modifications 

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Continued use of our services after modifications constitutes acceptance of the updated Terms. Material changes will be communicated via email to clients with scheduled appointments.
